16. City Attorney
1-16-3: EMPLOYEES IN THE OFFICE OF THE CITY ATTORNEY
1-16-1: APPOINTMENT: The City Council shall appoint a City Attorney for an indefinite period. The City Attorney shall be responsible to and serve at the pleasure of the Council.
1-16-2: DUTIES: (1592 Charter 3633)
(A) The City Attorney shall act as legal advisor to, and be attorney and counsel for, the Council and shall be responsible solely to the City Council. He shall advise any officer or department head of the City in matters relating to his official duties when so requested and shall maintain a copy of all written opinions given by him.
(B) The City Attorney shall prosecute ordinance violations and he shall conduct for the City cases in court and before other legally constituted tribunals. He shall file with the City Clerk copies of such records and files relating thereto as the City Council may direct.
(C) The City Attorney shall prepare or review all ordinances, contracts, bonds and other written instruments that are submitted to him by the City Council and City Manager and shall promptly give his opinion as to the legal consequences thereof.
(D) The City Attorney shall call to the attention of the Council all matters of law, and changes or developments therein, affecting the City.
(E) The City Attorney shall perform such other duties as may be prescribed for him by the Charter or by the Council.
(F) Upon the recommendation of the City Attorney, or upon its own initiative, the City Council may retain special legal counsel to handle any matter in which the City has an interest, or to assist and counsel with the Attorney.
(G) When consistent with the provisions of the Charter and the direction of the City Council, the City Attorney shall cooperate with the City Manager, effectuate the policies and objectives established by the City Manager, and give priority to requests made by the City Manager.

(A) Except for the City Attorney, employees in the Office of the City Attorney shall be either nonexempt or exempt employees and shall be subject to the provisions of Chapter 24 of this Title I. Recruitment and selection of employees in the Office of the City Attorney shall be conducted through the Department of General Services pursuant to Chapter 24 of this Title I.
(B) All employees in the Office of the City Attorney shall be responsible to the City Attorney.
