Land Development and Public Improvements

Section 11.5.1. Generally

       Land Development within the City may occur as provided by {the) City Council by ordinance.  Provision for land use and development within the City may include use, design, location, construction and bulk of buildings and other structures, intensity of use or density of development, utilities, private and public streets and avenues, parking facilities, drainageways, pedestrian areas, parks and common open space, ownership organizations, educational facilities, recreational facilities and other public improvements and facilities.  The authority of {the} City Council under this section is in addition to City Council authority under Section 4.16 of the Charter, and this section shall not be construed to restrict City Council authority under Section 4.16.

       The City may require agreements concerning land use and development and public improvements and facilities as a condition of approval of development.  The City may require providing public improvements and facilities its deems reasonably necessary as a condition of approval of land use and development.  The City also may provide for City construction of public improvements and facilities reasonably necessary to serve future land use and development which is determined to be in the City's interest.

       The City may establish and collect, in advance or otherwise, from land use and development payments for public improvements and facilities in the forms of development and impact fees and charges, dedications of property and fees in lieu thereof, and requirements of recovery of costs for public facilities provided to serve future land development.  the City may establish conditions upon and require agreements to provide public improvements and facilities to land use and development.  The City may provide for combinations of the foregoing and establish methods which effectuate the recovery of costs of public facilities and improvements it deems reasonably necessitated by and of benefit to land use and development within the City.

       The City shall have additional authority concerning land use and development and public improvements as is provided by Section 4.16 of the Charter and the Colorado Constitution and statutes.

       This section shall be liberally construed to accomplish its purpose of requiring new development, not current citizens, to bear the proportionate share of costs of benefits of public improvements and facilities reasonably necessitated by growth, mitigating the adverse effects of land development and promoting coordinated, innovative, high-quality planning to produce a well-balanced, technologically advanced City.  (As added 11-1-83)
